Welcome to Jump In. By using our mobile application, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using Jump In, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the app.

2. Eligibility

You must be at least 13 years old to use Jump In. By using the app, you represent that you meet this age requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these terms.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

4. User Conduct and Zero-Tolerance Policy

Jump In has a zero-tolerance policy for objectionable content and abusive behavior. Users who violate this policy will have their content removed and may be permanently banned from the platform.

When using Jump In, you agree not to:

• Violate any laws or regulations
• Harass, threaten, or intimidate other users
• Post false, misleading, or deceptive content
• Post obscene, offensive, hateful, discriminatory, or objectionable content
• Impersonate any person or entity
• Use the app for any illegal or unauthorized purpose
• Interfere with or disrupt the service
• Collect user information without consent
• Create activities that promote illegal or harmful behavior
• Use the platform to solicit, promote, or engage in any sexually explicit, violent, or otherwise inappropriate activity

5. Content Moderation, Reporting, and Blocking

5.1 Content Filtering

Jump In uses automated content filtering to detect and prevent objectionable language in user-generated content such as activity titles and descriptions. Content that does not pass our filters will not be published.

5.2 Reporting

Users can report objectionable content or abusive users at any time through the app. Reports can be submitted from any user profile or activity detail screen. All reports are reviewed by our team within 24 hours. When a report is substantiated, we will remove the offending content and take appropriate action against the user, up to and including permanent account termination.

5.3 Blocking

Users can block other users at any time through the app. When you block a user:

• You will no longer see their content, activities, or messages
• They will no longer see your content, activities, or messages
• Both users will be removed from any shared active activities
• Any crew (friend) connection between you will be removed
• Neither user will be able to join activities where the other is already participating

Blocked users are not notified that they have been blocked.

5.4 Enforcement

Jump In reserves the right to remove any content and terminate any account at any time for any reason, including but not limited to violations of these Terms. We will act on objectionable content reports within 24 hours by removing the content and ejecting the user who provided the offending content.

6. Activities and Meetups

Jump In is a coordination platform that facilitates connections between users for in-person activities (“Jumps”). Jump In does not organize, host, supervise, or control any activities. You acknowledge and agree that:

• No identity verification or background checks. Jump In does not conduct criminal background checks, identity verification, or screening of any kind on its users. We do not verify the accuracy, completeness, or truthfulness of any information provided by users, including activity listings.
• You participate at your own risk. Any interactions with other users, whether online or in person, are entirely at your own risk. Jump In is not a party to any meetup, activity, or arrangement between users.
• We are not responsible for user conduct. We are not responsible or liable for the conduct, whether online or offline, of any user of the platform. This includes, but is not limited to, any harm, injury, loss, or damage of any kind arising from your interactions with other users.
• Exercise caution. You should take reasonable precautions when meeting other people in person, including meeting in public places, informing a friend or family member of your plans, and trusting your instincts if a situation feels unsafe.

6.1 Assumption of Risk

You knowingly, voluntarily, and freely assume all risks, both known and unknown, of participating in any activity coordinated through Jump In, even if arising from the negligence or fault of other users. You alone are responsible for determining your fitness and ability to safely participate in any activity. You acknowledge that in-person meetups with people you have met through a digital platform carry inherent risks, including but not limited to risks of physical harm, property damage, emotional distress, and exposure to communicable illness. By using Jump In, you expressly agree to accept and assume all such risks.

6.2 Host Responsibilities

If you create an activity ("host a Jump"), you understand that you are solely responsible for the accuracy of the listing and any arrangements you make with other users. Jump In does not supervise, direct, or control hosts or their activities. Hosting through Jump In does not create an agency, partnership, joint venture, employment, or franchise relationship between you and Jump In.

7. Content

You retain ownership of content you post. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the service.

We may remove any content that violates these terms or that we find objectionable at our sole discretion.

8. Intellectual Property

Jump In and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

JUMP IN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WITHOUT LIMITING THE FOREGOING, JUMP IN MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION PROVIDED BY USERS, NOR DOES IT MAKE ANY WARRANTY REGARDING THE SAFETY, CHARACTER, REPUTATION, OR CONDUCT OF ANY USER. YOU ASSUME ALL RISK WHEN USING THE SERVICE, INCLUDING BUT NOT LIMITED TO ALL RISKS ASSOCIATED WITH ANY ONLINE OR OFFLINE INTERACTIONS WITH OTHER USERS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JUMP IN, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Personal injury, bodily harm, or property damage arising from your interactions with other users
• Emotional distress or psychological harm
• Unauthorized access to or alteration of your data or transmissions
• Conduct of any third party on the service, whether online or offline
• Any content posted, shared, or obtained through the service
• Loss of profits, data, use, goodwill, or other intangible losses

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU HAVE PAID TO JUMP IN IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND EVEN IF JUMP IN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Jump In and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

• Your use of or inability to use the service
• Your violation of these Terms of Service
• Your violation of any rights of any third party
• Your interactions with other users, whether online or offline, including any activities, meetups, or events coordinated through the service
• Any content you post, submit, or transmit through the service

This indemnification obligation will survive the termination of your account and your use of the service.

12. Termination

We may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these terms or is harmful to other users or our business interests.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes by posting the updated terms in the app or by other means. Your continued use of Jump In after changes constitutes acceptance of the new terms.

14. Dispute Resolution

You and Jump In agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the service shall first be resolved through good-faith informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may initiate binding arbitration in accordance with the rules of JAMS. The arbitration shall take place in the State of Washington. You agree to waive any right to a jury trial or to participate in a class action or representative proceeding.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

16. SMS/Text Messaging Terms

Jump In offers SMS-based authentication for account login and sign-up. By providing your phone number and requesting a verification code, you consent to receive text messages from Jump In.

• Message frequency: One message per login/sign-up attempt
• Message and data rates may apply
• Reply STOP to opt out. Reply HELP for help.

You can opt out of receiving SMS messages at any time by replying STOP to any message. After opting out, you will no longer receive verification codes via SMS and will need to use email for authentication.

Supported carriers are not liable for delayed or undelivered messages. SMS messages are used solely for authentication and will never be used for marketing or promotional purposes.
